1. Starting from July 2008, all participants will be required to make an EMD payment of 5,000 euro with Siltronic before they are allowed to participate in the e-auctions.

2. This is a one-time payment only.

3. The EMD will be waived for bidders who satisfy the following pre-conditions:

a) previously completed a sale on the e-auction, AND

b) never been suspended from any prior e-auctions

4. The EMD will be refunded (interests-free) on demand upon the bidder’s request to withdraw from all future Siltronic e-auctions, or if the bidder subsequently qualifies for a waiver.

5. All incoming and outgoing bank related charges, with respect to the placement of the EMD with Siltronic, will be borne by the bidder.

6. The EMD may be forfeited in the event of a breach of the e-auction Rules and / or Terms & Conditions.

7. To be eligible to participate in the e-auction for the first time, the EMD needs to be deposited and received by Siltronic by 9am of the 25th day of the prior calendar month (Singapore time). E.g. by June 25th, for the July e-Auction.

8. EMD remittance instructions will be provided separately by Siltronic. Bidders will also be required to provide relevant information to facilitate the processing of future request for EMD refund.
